1. Introduction

This Privacy Policy describes how the TR Stamp application (the “App”) collects, uses, and protects your information (“User” or “you”). We are committed to complying with applicable laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and the General Data Protection Regulation (GDPR) for our users in relevant jurisdictions.

2. Information We Collect

Our data collection is solely for the purpose of enabling storage and retrieval of your registered information within the App.

a. Information You Provide Directly:

To utilize the App’s registration features, you must register and upload pertinent data. This may include:

  • Registration Information: Information provided during account registration (e.g., username, email address, password).
  • Uploaded Data: The original copyrighted documents and their types of materials that you choose to register and upload.

b. Information Collected Automatically:

  • Usage Data: Information about your use of the App, such as login times, features accessed, and actions taken within your account. This data helps us maintain and improve the App’s functionality.
  • Device Information: Information about your device, such as device model, operating system, and unique device identifiers. This is used for security and to ensure optimal App performance.
  • Log Data: Information about App usage, including crashes and errors, for debugging and improving stability.

c. No Sale of Data:

We do not sell your data of any kind to third parties. Your information is used solely to provide you with the App’s registration, storage, and retrieval services.

d. Compliance with CCPA/CPRA and GDPR:

We are committed to complying with the CCPA/CPRA for our users in California and the GDPR for users in relevant European jurisdictions. Your rights under these regulations are outlined below.

e. No Responsibility for Registered Document Contents:

Title Registry is not responsible for the contents of the documents you choose to register and upload. You are solely responsible for the legality, accuracy, and ownership of the materials you register.

3. How We Use Your Information

We use the collected information for the following purposes:

  • Storage and Retrieval: To securely store your registered original copyrighted documents and related data and enable you to access and retrieve them.
  • Account Management: To manage your user account, including registration, login, and account deletion.
  • App Functionality: To provide and maintain the core features of the App, including secure storage and retrieval of your registered works.
  • Security: To protect the security and integrity of the App and user accounts.
  • Improving the App: To analyze usage patterns and identify areas for improvement in the App’s functionality and user experience.
  • Communication: To communicate with you regarding your account, important updates, and support inquiries.

4. Sharing Your Information

We only share your information in the following limited circumstances:

  • Service Providers: We may use third-party service providers to assist with functions such as data storage, security, and app maintenance. These providers are contractually obligated to protect your information and use it only for the services they provide to us.  
  • Legal Compliance: We may disclose your information if required by law, legal process, or a government request, and to comply with all applicable US state and federal laws.  

5. Your Rights

a. Right to Delete Account and Data:

Users may delete their account and any associated data at any time. Upon your request, we will permanently delete your account and the data you have uploaded. Deleted data will not be restorable.

b. Rights Under CCPA/CPRA (for California Residents):

  • Right to Know: You have the right to request information about the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we share it.  
  • Right to Delete: You have the right to request the deletion of your personal information, subject to certain exceptions.
  • Right to Correct: You have the right to request the correction of inaccurate personal information we hold about you.  
  • Right to Opt-Out of Sale or Sharing: As stated above, we do not sell your data. We also do not “share” your personal information as defined under the CCPA/CPRA for cross-context behavioral advertising.
  • Right to Non-Discrimination: You have the right not to receive discriminatory treatment for exercising your CCPA/CPRA rights.  
  • Right to Limit Use and Disclosure of Sensitive Personal Information: We strive to minimize the collection of sensitive personal information. If we do collect such information in the future, you will have the right to limit its use.

c. Rights Under GDPR (for Users in Relevant European Jurisdictions):

Under the GDPR, you have the right to:

  • Access: Request access to your personal data.
  • Rectification: Request correction of inaccurate or incomplete personal data.  
  • Erasure (“Right to be Forgotten”): Request the deletion of your personal data.
  • Restriction of Processing: Request the restriction of processing your personal data.
  • Data Portability: Request to receive your personal data in a structured, commonly used, and machine-readable format and to transmit it to another controller.  
  • Object: Object to the processing of your personal data in certain circumstances.
  • Withdraw Consent: Withdraw your consent at any time where processing is based on consent.
  • Lodge a Complaint: Lodge a complaint with a supervisory authority.  

d. Exercising Your Rights:

To exercise any of your rights, please contact us using the information provided in Section 9. We will respond to your request in accordance with applicable laws. We may need to verify your identity before fulfilling your request.  

6. Data Security

We implement reasonable security measures to protect your information from unauthorized access, use, or disclosure. However, no method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security.  

7. Data Retention

We will retain your information for as long as your account is active or as needed to provide you with the services. If you delete your account, we will delete your data as described in Section 5a. We may retain certain information as required by law or for legitimate business purposes (e.g., audit logs).  

8. Children’s Privacy

The App is not intended for children under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16, we will take steps to delete such information as soon as possible.

10. Public Searchable Database

Our public searchable database contains records of all registered original copyrighted documents and their types of materials, only. No personal information of the registering users is included in this public database.

11. TR Symbol and Number

The square with the letters “TR” inside is a symbol that represents that an original work has been registered with Title Registry and resides in our registry. Each registered unique work is assigned a unique “TR Number,” specific to that registration.

12. Legal Compliance

We comply with all United States federal and state laws for legal compliance.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will provide notice of any material changes, such as by posting the updated policy within the App or on our website and updating the “Last Updated” date. Your continued use of the App after the effective date of the revised Privacy Policy constitutes your acceptance of the changes.
